The High Court has thrown out an injunction application by Nana Akua Afriyie, the NPP’s 2024 parliamentary candidate for Ablekuma North, aimed at stopping the Electoral Commission (EC) from conducting a rerun in 19 polling stations scheduled for July 11.
Presiding Judge Justice Ali Baba Abature described the application as “unmeritorious,” emphasizing that the EC’s constitutional duty to ensure proper representation outweighed the candidate’s objections.
Afriyie’s legal team argued that the EC was disregarding a January 4 court order which instructed it to collate and announce results from 62 polling stations. They contended that the EC had earlier acknowledged only three polling stations remained uncollated, and labelled the planned rerun as unlawful and contemptuous.
However, the court held that Afriyie failed to demonstrate that the EC could declare results without further verification. Justice Abature stated that any legal concerns with the EC’s actions should be addressed through substantive proceedings, not by stopping the electoral process.
He concluded that if Afriyie ultimately prevails in court, the EC could be directed to pay damages, but the rerun itself could proceed as planned.
